These Terms of Service (“Terms”) govern your access to and use of our website, mobile applications, and other online products and services (collectively, the “WheelCrazes Services” or “Services”) provided by WHEELCRAZES INC. (“WheelCrazes,” “we,” “us,” or “Company”).

PLEASE READ THESE TERMS CAREFULLY, including the mandatory arbitration provisions in Section 24, which require disputes to be resolved by final and binding arbitration on an individual basis, not as a class or consolidated action. You may opt out of arbitration as described in Section 24.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

WheelCrazes may provide additional terms for third-party services, payment processors, or fulfillment providers. In the case of conflict, those additional terms take precedence.

We may update these Terms periodically. Continued use of Services constitutes acceptance of any changes.

1. Parties and Agreement

You (“User”) and WheelCrazes Inc. (“Company”) are parties to this agreement.
Accessing this Website constitutes agreement to these Terms.
You are granted a limited, non-transferable right to access the Website and affiliated sites.
WheelCrazes may modify these Terms at any time; updates will be posted on the Website.
Bookmarking or accessing pages constitutes your agreement and confirms you are at least 18 years old.

2. Use of Website

You agree not to:

Violate laws or WheelCrazes policies
Post false or misleading content
Infringe on third-party rights
Distribute spam or malware
Use scraping/automation tools without permission
Harvest user data without consent
Circumvent access restrictions

3. WheelCrazes Services

3.1 Posting Items

Users may post bikes for sale by uploading images and descriptions free of charge.

3.2 Buying and Selling

WheelCrazes facilitates transactions through our WheelCrazes Payment Solution. Transactions are primarily between users; WheelCrazes is not a party except as described in our Buyer Protection Program.

3.3 Payment Accounts

Using the payment system requires agreement with our payment provider (currently Adyen). Compliance is mandatory.

3.4 Taxes

Users are responsible for taxes. WheelCrazes may request tax documentation for reporting requirements.

3.5 Shipping

Sellers must follow our shipping policies. Buyers pay shipping costs. WheelCrazes is not responsible for shipping delays, damage, or loss. Hazardous items (e.g., lithium batteries) must follow ground shipping protocols.

4. User Code of Conduct

Users must not:

Disrupt Services or infringe on other users
Engage in harassment or predatory behavior
Transact outside the WheelCrazes platform
Sell prohibited items
Provide false information or impersonate others
Use gift cards or cryptocurrency without authorization
Copy or reverse-engineer WheelCrazes Services

Violation may result in suspension or termination.

5. Information Collection

WheelCrazes may collect:

Personal Information: Name, address, phone, email, login credentials, payment details
Anonymous Information: IP address, browser type, pages visited, usage patterns

Purpose: Account verification, transactions, customer service, communications, website security, and service improvement.

6. Use of Information

By submitting information, you grant WheelCrazes the right to store and use it for user experience improvement, demographic analysis, and communications. Cached search engine data may remain outside our control.

7. Accounts, Passwords, and Registration

Users are responsible for account security. Notify WheelCrazes immediately of any suspected breach.

8. Content Ownership

Users retain ownership of content submitted but grant WheelCrazes a non-exclusive, royalty-free license to use it as necessary to deliver services.

9–14. Website Conduct and Intellectual Property

Report offensive content to help@wheelcrazes.com
Limits may be imposed on storage, usage, or access
Third-party posting agents require permission
No spam or unsolicited communication
WheelCrazes owns all trademarks, logos, and proprietary content
Intellectual property infringement claims should be submitted in writing

15–18. Liability and Disclaimers

WheelCrazes is not responsible for other users’ actions or content
Services are provided “as is”; use at your own risk
Using an internet-based marketplace carries inherent risks, including in-person exchanges
Limitation of liability: Indirect, incidental, or consequential damages are limited; total liability capped at $100 or your payments in the past 12 months, except for gross negligence or fraud

19. Buyer Protection

WheelCrazes Buyer Protection covers:

Warranty claims against sellers
Defects, non-performance, or misrepresentation
Claims must be made within 48 hours of delivery

Procedures: Inspection, repair, or return handled via WheelCrazes. Buyer Protection does not apply to size mismatches.

20–22. Legal Terms

Release: Users release WheelCrazes from liability related to disputes between users
Data Processing: Consent to data transfer and storage in the U.S. and other countries
Indemnity: Users agree to cover claims arising from content, violations, or misuse

23. Termination

WheelCrazes may suspend or terminate access at any time. Post-termination access is prohibited.

24. Dispute Resolution

No Class Actions: Disputes must be individual
Arbitration: Binding arbitration via JAMS; governed by FAA
Opt-Out: Email support@wheelcrazes.com within 30 days to opt out
Claims Period: One year to file claims

25–35. Miscellaneous

WheelCrazes retains content ownership and grants limited licenses
Force majeure applies
Relationships: No partnership, employment, or agency
Security: Reasonable measures, no absolute guarantee
Copyright complaints: Report to designated agent
Privacy Policy applies
Corporate transfers may include your personal data
Feedback or suggestions are non-confidential and freely usable
Entire agreement supersedes prior agreements
